Rental Agreement

YOUR WRITTEN OR ELECTRONIC SIGNATURE ON THIS AGREEMENT, ELECTRONIC ACCEPTANCE OF THIS AGREEMENT, OR PAYMENT OF MONEY OR TAKING POSSESSION OF THE PROPERTY AFTER RECEIPT OF THE AGREEMENT IS EVIDENCE OF YOUR ACCEPTANCE OF THE AGREEMENT AND YOUR INTENT TO USE THIS PROPERTY FOR A VACATION RENTAL. THIS AGREEMENT SHALL NOT BE CONSIDERED BINDING UNTIL SIGNED BY IAN OR KAREN COREY. This Vacation Rental Agreement ("Agreement") entered by and between Ian and Karen Corey ("Owner", "we", "us", "our"), as the Owners of Tranquility Point ("the Property", "the cabin"), and the undersigned ("Tenant", "you", "your") whether one of more. In consideration of the mutual covenants and conditions herein, Owner does hereby lease and rent to Tenant the Property named here in following terms and conditions.

1. SECURITY DEPOSIT/DAMAGE DEPOSIT: If you consent to the terms of this Agreement, we require a security deposit of $200 to be paid within seven (7) days upon making the reservation. We accept personal checks, and major credit cards through PayPal (please note that you DO NOT need a PayPal account to pay by credit card over PayPal´s secure server). Upon your arrival, the security deposit converts to a damage deposit. We will return your security deposit within one (1) week after you check out, less any damages or excessive cleaning fees, provided the following provisions are met:

a. No damage is done to the property or its contents (including, but not limited to, hot tub, hot tub cover, pool table, and pool table accessories) beyond normal wear and tear, and no contents are missing;

b. Property is not left dirty and all refuse is placed in the garbage cans in the bear-proof container outside;

c. Linens are in good condition and none are missing;

d. Dishware, glassware, cookware, and utensils are washed and put away in the cabinets;

e. No early check-in or check-out unless approved in advance;

f. No occupancy greater than the stated maximum of six (6);

g. No pets unless approved in advance;

h. No damage due to pets;

i. No smoking inside the property.

2. PAYMENT: Your balance due (including taxes) and due date will be included on your receipt confirmation. All reservations must be paid in full within thirty (30) days prior to your arrival date. We accept payment by personal check, or by major credit card through PayPal (please note that you DO NOT need a PayPal account to pay by credit card over PayPal´s secure server). If your arrival date is less than thirty (30) days from the date you are making the reservation, we will require payment of the entire amount due by credit card at the time of booking. Once payment is received, we will provide you a welcome packet that includes directions, a keyless entry code, and other useful information for your stay.

3. CANCELLATION: Should you have to cancel your reservation for any reason, please notify us immediately in writing (US Mail or e-mail to info@tranquility-point.com). If you cancel less than thirty (30) days before your arrival date, you will forfeit your entire security deposit of $200. If you cancel thirty (30) or more days before your arrival date, your security deposit will be refunded less a $100 cancellation fee. If you cancel and have already paid for your stay, we will refund your lodging payment if we can re-rent Tranquility Point for your cancelled dates. We reserve the right to automatically cancel your reservation if payment is not received in full thirty (30) days prior to your arrival date. We will not issue refunds for no-shows, shortened stays because of late arrival or early departures, or inclement weather. If you are concerned about possible cancellation, we highly recommend obtaining travel insurance to cover your trip.

4. CHECK-IN/CHECK-OUT: Check-in time is no earlier than 3:00 pm (Eastern Time) at the property. Upon receipt of final payment, we will provide you a code for keyless entry of the property. Check-out time is no later than 10:00 am (Eastern Time). Please do not arrive early or depart late as this will adversely affect the ability of our housekeeping staff to prepare the premises for occupancy. If you do not vacate the property by the stated check-out time, you will be charged $50 for each additional thirty (30) minutes you occupy the property, up to the amount of one (1) night´s stay. Early check-in may be available in some cases; please contact us to determine whether early check-in will be possible.

5. TELEPHONE SERVICE: We provide local telephone service at the Property. Long distance and collect calls are blocked. You may, however, make toll-free calls which will allow you to use callings cards.

6. ACCOMMODATIONS & FURNISHINGS: The Property is privately owned and furnished by Owner according to their taste. Kitchens come stocked with adequate cookware and dinnerware. Beds have mattress pads, bedspreads, and pillows. You will need to bring all paper products, soaps, staples, personal items and linens (unless provided) including kitchen linens. No refunds will be made for items missing or inadequacies but every effort will be made to replace missing items or to repair any damages.

7. PET POLICY: With prior approval and payment of a non-refundable $75 pet fee, you may bring a small (thirty-five (35) pounds or less), well-behaved dog. Pets must have current vaccinations and be on a current flea/tick control program. Pets are not allowed on furniture at any time and you will be responsible for cleaning up any pet refuse. We assume no responsibility for illness or injury that may occur to pets during your stay, or injury caused to humans or other animals by your pet. If you bring a pet without obtaining prior approval and/or paying the $75 pet fee, you will forfeit your security deposit and will be evicted without refund.

8. CONDITION OF PROPERTY: When you arrive, the property should be clean and ready for your stay with the following linens: linens for both queen beds (with beds made), linens for the queen sleeper sofa, blankets, pillows, twelve (12) bath towels, four (4) hand towels, six (6) washcloths, and two (2) bath mats. Also, you will find a starter supply of toilet paper, paper towels, hand soap, shampoo, laundry detergent, dishwater detergent, dish soap, and trash can liners. If the cabin has not been cleaned when you arrive, please contact us immediately. We will do our very best to correct the situation. We provide games, movies, and books for our guests. Some games have small pieces or parts that are not suitable for small children. Do not allow small children to play with games without supervision. Also, we strive to have a selection of books and movies that will appeal to guests of varying ages, so you may find some books or movies unsuitable for your child(ren).

9. REPAIRS & SERVICE CALLS: We take pride in maintaining our cabin and perform regular maintenance to keep everything in good working order (we like to stay there too!). It is impossible, however, to guarantee that all appliances, hot tub, fireplaces, etc., will be in working 100% of the time. We will, however, make every effort to correct any problem you encounter during your stay as soon as possible. Non-emergency maintenance issues will be handled during normal business hours. If you need emergency maintenance, please contact Cabin Services at (865) 774-0132, otherwise contact us. While we will attempt to correct all issues as quickly as possible, no refunds will be made for mechanical failures of hot tub, appliances/electronics, or interruption/loss of utilities (including satellite TV). Authorized repairmen have the legal right to enter the property as required to accomplish needed repairs even if the service call was made prior to your arrival.

10. PERSONAL ITEMS LEFT BEHIND: We are not liable for personal items left behind, lost or stolen. If you leave something behind that you want returned to you, please contact us as soon as possible. You will be responsible for shipping and handling costs, which will be deducted from your security deposit.

11. HOT TUB: Use of the hot tub is at your own risk. Our housekeeping staff will drain, clean and disinfect the hot tub after every rental. Bromine is used to maintain the water quality; some individuals are sensitive to bromine and it can damage jewelry finishes. We recommend that pregnant women and individuals with pre-existing health conditions such as heart disease, diabetes, or high or low blood pressure, as well as individuals who have consumed alcoholic beverages, not use the hot tub. Minors must be supervised at all times while in and around the hot tub. The hot tub cover must be placed back over the hot tub after every use, and should not be stood or sat on. Lotions, oils, or soaps may not be used in the hot tub as they could cause severe damage and may result in the need for extra cleaning. If there is a problem with the hot tub, please call Cabin Services at (865) 774-0132.

12. PARKING: No motor homes or campers are allowed on the property.

13. DEPARTURE DUTIES: Prior to check-out, all dishware, glassware, cookware, and utensils should be washed and put away in cabinets, or in the dishwasher with the wash started. Do not strip beds (i.e., please leave them unmade with sheets and pillowcases left on). Towels from both bathrooms should be gathered and placed in the downstairs bathtub. Place all refuse in the garbage cans contained in the bear-proof container across from the parking area. Ensure hot tub is covered. Set the thermostat to 65 degrees during the cooler months and 75 degrees during the warmer months. Ensure all windows and keyed doors are locked, and place any keys on the kitchen counter. After exiting the front door, press the "lock" button on the keyless entry then ensure the door has been locked.

14. GAS FIREPLACES: The property has two gas fireplaces. These fireplaces will be operable only from October 1 - April 30. Please read all instructions when operating the fireplaces.

15. SMOKING: This is a non-smoking property. Smoking is permitted outside on the covered deck, but absolutely prohibited inside. Any violation of this policy will result in forfeiture of your entire security deposit. If you smoke outside, please ensure butts are out and disposed of in appropriate outside receptacles. If the housekeeping staff has to pick up butts, $25 will be deducted from your security deposit.

16. MINIMUM AGE AND MAXIMUM OCCUPANCY: You must be at least twenty-one (21) years of age to rent this property. We will not rent to vacationing students or singles under twenty-five (25) years of age unless accompanied by a parent or legal guardian. The property is to be occupied by no more than six (6) persons at any time. Violation of either of these terms will result in eviction and forfeiture of your security deposit and rent.

17. HOUSE PARTIES: House parties are strictly prohibited and grounds for immediate eviction and forfeiture of your security deposit and rent.

18. INDEMNIFICATION AND HOLD HARMLESS; RIGHT OF ENTRY; ASSIGNMENT: Tenant agrees to indemnify and hold Owner harmless from and against any liability for personal injury or property damage sustained by any person (including Tenant´s guests) as a result of any cause, unless caused by negligent or willful act of Owner. Tenant agrees that Owner or Owner´s representatives may enter the Premises during reasonable hours to inspect the Premises, to make such repairs, alterations or improvement thereto as Owner may deem appropriate. Tenant shall not assign this Agreement or sublet the Premises in whole or part without written permission of Owner.

19. ADDITIONAL TERMS AND CONDITIONS.

a. If a personal check is returned to us for non-sufficient funds, you will be charged any fees the bank charges us.

b. Any modifications to the terms and conditions above must be approved in advance by Owner.

c. Rates, terms and conditions are subject to change without notice.

I HAVE READ AND UNDERSTAND THE TERMS AND CONDITIONS ABOVE. I HEREBY CERTIFY THAT I AM AT LEAST TWENTY-ONE (21) YEARS OF AGE AND THAT I WILL BE HELD RESPONSIBLE FOR THE CARE OF THIS PROPERTY BEING RENTED UNDER MY NAME. I ACCEPT FULL RESPONSIBILITY FOR DAMAGES OR EXTRA CLEANING CHARGES SHOULD THEY BE DISCOVERED DURING OR AFTER MY DEPARTURE.
